בקרוב - טיפול שורש במתרחש בתחום הרפואה בצה"ל !
אנוכי יחד עם צוות משפטנים יוזמים מדיניות חדשה כלפי אלו שמעשיהם ו/או התרשלותם גורמים לנזק ולסיכון בריאותי לחיילי צה"ל עם סיום ההכנות והודעה לצה"ל - נתחיל ביישומה.
לאתר ("הקשב" - www.hakshev.co.il) לא מפסיקות לזרום תלונות על התנהלות רופאים או התעלמות מפקדים מחוו"ד רפואיות .
מצב בו מפקדים לא חוששים לקחת סיכון לבריאות וחיי חיילים ומנגד רופאים הרואים עצמם כ"חלק מהמרכת" למילוי הוראות המפקדים ושוכחים מהי משימתם ותחום אחריותם, יאלצו להתמודד עם הליכים מינהליים ומשפטיים .
בצה"ל לא השכילו להבין ולשדר את המסר כי למפקדים אסור להם להתערב בהמלצות רפואיות מחד ומאידך לרופאים הצבאיים אסור לשקול שיקולים פיקודיים במקום רפואיים. ואני מדגיש : התחשבות בצרכי הצבא כחלק מהשיקול כן - איזון בינהם כן - אך לעולם השיקול הרפואי לא יסוג מפני זה הפיקודי.
ואם בצה"ל לאורך השנים לא למדו דבר כי לא ננקטו עלידי פיקוד הצבא ואף לא ע"י הערכאות המשפטיות צעדים של ממש אלא במקרים נדירים, בעיקר עקב תוצאה קטלנית כמו מותו של חייל - וגם אז לא ראינו בכל מקרה העמדתם של האחראים לדין - בקרוב המצב ישתנה .

כמו במקרים אחרים לרבות מבצעיים - לא אחת, צה"ל אינו מיישם מסקנות.

מפקדים שיקחו על עצמם אחריות להתעלם מהמלצות רפואיות או רופאים שימנעו מהמלצות או החלטות רפואיות שכל רופא סביר היה נוקט רק משום שהרופא הצבאי רואה עצמו חלק מהמערכת - ישאו בתוצאות מעשיהם ו/או מחדלם ובכלל זה נפעל להשהייה או שלילת רשיון לעסוק ברפואה.

אנו מודעים לכך שיש לעשות הכל לא לפגוע כהוא זה בסמכותם של המפקדים ואולם - תחום הרפואה מעולם לא היה בתחום סמכותם.
